Kathmandu, Nepal April 16, 2019: The Supreme Court (SC), the Apex Court of the country, has on Tuesday upheld the decision of Ministry of Home Affair’s (MoHA) to issue citizenship by descent.
Earlier on April 9, the SC had issued an interim order to suspend the MoHA’s circular to the District Administration Office (DAO) of all districts to issue citizenship by descent.
Challenging to the MoHA’s decision, senior advocate Balkrishna Neupane had moved to the court seeking immediate halt of the government decision to issue citizenship by descent.
A division bench of Justice Hari Krishna Karki and Bam Kumar Shrestha made the final verdict in favor of the MoHA to issue citizenship by descent.
Following the government’s decision to continue the MoHA’s circular to issue citizenship by descent, the society had divided over the issue suspecting that many Indian national would get citizenship certificates with the provision.
With the SC’s decision to uphold the MoHA’s decision to issue citizenship by descent, the children of those obtaining citizenship by birth will able to obtain the citizenship.
As the bill to amend the Citizenship Act is still under discussion in the federal parliament, the concerned experts have a view that any decisions about the citizenship have to be made only after promulgation of the necessary law.
