Kathmandu, Nepal:  The Supreme Court, the apex court of the country, has issued a show-cause notice against the Nepal government for its preparations to change the provincial boundaries through an amendment to the Constitution of 2072.
 
Responding to the writ petition filed by advocate Tika Dhoj Khadka, a single bench of Chief Justice Sushila Karki issued such a show cause notice on Tuesday. 
 
The Court order has asked the defendants -- the Office of the Prime Minister and Council of Ministers, the Parliament and the plaintiff, advocate Khadka to come up with their arguments over whether or not to issue a stay order over the issue.
 
Advocate Khadka had moved to the court on Monday seeking a stay order against the government’s preparation to revise the provincial boundaries through an amendment to the Constitution of Nepal 2072.
 
The writ petitioner has challenged the government efforts arguing that the boundaries of provinces could not be changed without the consent of the concerned provinces. 
 
Since provinces had not been formed yet, the efforts to revise boundaries would be an unconstitutional act, Advocate Khadka has argued in the writ.
 
The show-cause order from the Supreme Court has come in the mean time when the government is preparing to register the constitution amendment proposal in the parliament within few days. 
 
Though the Nepali Congress, a major ally of the incumbent government, has not made any official decision regarding the issue, the government head, CPN Maoist Center, has on Tuesday officially decided to split some Terai districts from the province number five.
 
The decision is protested not only from the political level but also from the level of people as well. Local people of the province number five have been protesting the government’s preparations to separate Terai from hills.
