Guwahati : Around 2000 transgender in Assam who were excluded from the final National Register of Citizens (NRC) which was published on August 31, are still hoping that, the Supreme Court will modify the appeals process of the NRC for inclusion their names in the list.
Around 2000 transgender are among the 19 lakh people who were left out from the final NRC.
Before the final draft of NRC was published, the transgender community of Assam had immediately moved an intervention application in the Supreme Court and the intervention application has not yet been dismissed.
The 2000 transgender, who were excluded from the final NRC are still hoping that the apex court will consider the matter.
Assam's first transgender judge and petitioner Swati Bidhan Baruah said that – "we are hoping that the Supreme Court will take into consideration about our intervention application and will make a necessary reasonable order on that, so that, the transgender will not be excluded from the NRC."
There are around 20,000 transgender in Assam.
"Almost all of them (transgender) had applied. But, the important thing is that, 2000 has been excluded from the list. Why it is so, because in the first application which was distributed door to door and in that application, there was a specific sex quota mentioning the options of male, female and others. When using the option others normally allowing the transgender persons to participate in the process. But, simultaneously in the claim and objection application there you would not find any sex quota. So that means, if I am applying under the other option as the transgender in the first application and I couldn't find my name in the first draft then I have to apply for claim and objection and there is no any sex quota under which quota I will apply that. So there is a very huge lacuna and what I believe is that, the entire NRC was not very much inclusive for this community and which is violated the NALSA judgement that we have elaborated in our intervention application. Now we are hoping that, the Supreme Court will give a reasonable justification and reasonable order for the transgender community so that they are not being excluded from the same list," Swati Bidhan Baruah said.
