Guwahati : The BJP led Assam government faces another problem following the opposition and its own party legislators demanded to amendment the new provincialisation bill for the venture educational institutions, which was tabled in the Assam assembly on Monday.
On behalf of Assam education minister, parliamentary affairs minister Chandra Mohan Patowary had submitted the the Assam Education (Provincialisation of Services of Teachers and Re-Organisation of Educational Institutions) Bill, 2017 in the Assam assembly.
The opposition and several BJP legislators raised that, most of venture educational institutions of the state will again deprived from the new bill and they demanded to amendment it.
'The new bill will not be covered many venture educational institutions and again many teachers-employees, who served since long time without single a penny,' opposition AIUDF MLA Aminul Islam said.
The state government has tabled the new provincialisation bill for the venture educational institutions, following the directives of the Gauhati High Court.
The new bill said that, the Assam Venture Educational Institutions (Provincialisation of Services) Act, 2011 as amended vide the Assam Venture Educational Institutions (Provincialisation of Services) (Ammendment) Act, 2012 and the Assam Venture Educational Institutions (Provincialisation of
Services) (Ammendment) Act, 2013, which had been struck down by the Gauhati High Court on September 23, 2016 in a writ petition and all rules, orders, notifications issued thereunder shall repealed, however, all teachers whose services were provincialised prior to September 23, 2016 shall continue and their cases shall be reviewed as per the eligibility norms set forth for provincialisation under the new bill.
The new bill stated that, the venture educational institutions which have been established and had obtained the required permission, recognition, affiliation, concurrence, as the case may be up to the last and highest class required for the concerned institution from the respective component
authority or authorities on or before 1-1-2006, and order issued thereafter with any retrospective effect, shall not be considered for the purpose of provicialisation of services of any teacher and tutor, as the case may be, of the institution.
The bill also stated that, the Assam government will identify base school for the purpose of provincialisation of services of teachers of the venture educational institutions so as to fulfill the norms and standard required for providing educational institutions within a specified areas as at least one lower primary school within a radius of 1 km, at least on upper primary school within a radius of 3 km, at least one high school or high madrasa within a radius 5 km and at least one higher secondary school or junior college within a radius of 7 km.
'The tutor must acquire the prescribed educational and professional qualifications within a period of five years from the date of publication of the order provincialisation of services of the teachers and ortutors of the concerned venture educational institutions in the official gazette and after acquirement of required qualification, they shall be upgraded to the post of teacher in appropriate cadre,'Â the bill stated.
