Kathmandu, Nepal, March 3, 2023: A writ petition has been registered at the Supreme Court (SC), the apex court of the country, on Monday against the Office of the Attorney General (OAG) demanding investigation on Rastriya Swatantra Party (RSP) president Rabi Lamichhane’s passport misuse case.
Advocate Yuvraj Saphal, who had previously filed a writ against Lamichhane's citizenship dispute, moved to the SC to file a fresh writ petition against the decision of the OAG not to prosecute him in the passport dispute.
In the writ, he has demanded a mandamus order against the decision of the AOG to overturn the decision and to investigate and prosecute the case in an impartial manner. The OAG, Attorney General Dinmani Pokharel, District Administration Office Kathmandu, Department of Immigration, Nepal Police Headquarters, Kathmandu Valley Police Office Election Commission including RSP president Lamichhane have been termed as opponents.
The decision of the OAG not to proceed with criminal proceedings is contrary to the basic principles of criminal jurisprudence and biased against those who have attained power, which give the sense that the law is only applied for the general public, petitioner Saphal has stated in the writ petition.
Meanwhile, the SC has scheduled the hearing on the writ petition against Lamichhane is scheduled for Tuesday.
