Kathmandu, Nepal, July 12, 2021: The verdict passed by the Supreme Court on Monday over the issue of House dissolution has been applauded from different sectors except the faction of the ruling CPN UML led by KP Sharma Oli.
Not only the political leaders of the opposition alliance but also the constitutional experts have applauded the verdict terming that the verdict has helped to bring into track the derailed country’s political as well as constitutional process.
Issuing a press statement later on Monday Nepali congress has welcomed the verdict stating that the verdict has brought the derailed political as well as constitutional process adhering independence of judiciary, rule of law and democracy.
Likewise, the Nepali Congress has also thanked one and all for the help to protect the democracy and rule of the law in the country.
The Supreme Court has on Monday made a landmark verdict overturning the government’s decision to dissolve House of Representatives (HoR). President Bidya Devi Bhandari had dissolved the HoR for the second time at the recommendation of the government.
The constitutional bench formed at the SC to hear the case filed against the HoR dissolution has also ordered the Office of President to appoint Nepali Congress President Sher Bahadur Deuba as new prime minister by Tuesday and summon fresh session of the HoR at 5 PM on July 18. Different writ petitions including a petition on the sign of 146 lawmakers were filed demanding appointment of Deuba as the new Prime Minister.
While passing the verdict Chief Justice Cholendra SJB Rana, who is also the chief of the constitutional bench, also stated that whip does not apply when lawmakers take part in the voting to elect new Prime Minister as per Article 76(5) of the constitution.
