Kathmandu, Nepal, July 12, 2021: Supreme Court (SC), the Apex Court of the country, has on Monday made a landmark verdict overturning the government’s decision to dissolve House of Representatives (HoR). President Bidya Devi Bhandari had dissolved the HoR for the second time at the recommendation of the government. 

The constitutional bench formed at the SC to hear the case filed against the HoR dissolution has also ordered the Office of President to appoint Nepali Congress President Sher Bahadur Deuba as new prime minister by Tuesday and summon fresh session of the HoR at 5 PM on July 18. Different writ petitions including a petition on the sign of 146 lawmakers were filed demanding appointment of Deuba as the new Prime Minister. 

While passing the verdict Chief Justice Cholendra SJB Rana, who is also the chief of the constitutional bench, also stated that whip does not apply when lawmakers take part in the voting to elect new Prime Minister as per Article 76(5) of the constitution.
