Kathmandu, Nepal, July 27, 2023: The verdict on the dispute regarding the unconstitutionality of the formation of the Koshi state government will be delivered today. The verdict on the writ petition filed challenging the unconstitutionality of the formation of the Koshi state government is going to be decided today.
The hearing, which has been going on since Tuesday, was postponed to Thursday after it was not completed even yesterday. Even though the debate is over, it has been put on hold for Thursday stating as it will take time to write the verdict.
The full bench of Supreme Court Justices Ishwar Prasad Khatiwada, Anand Mohan Bhattarai and Til Prasad Shrestha is hearing the writ petition.
The immediate past Chief Minister Hikmat Kumar Karki had filed a writ petition in the Supreme Court challenging the legality of the Chief Minister appointment process in Koshi Province.
As the provincial government was formed under the leadership of Thapa, the outgoing Chief Minister Karki had registered a writ stating that the process was unconstitutional as the signature of Baburam Gautam, the Speaker of the Koshi Province was also used in the government formation process.
As requested in the writ petition, the court will give a verdict on whether the signing of the Speaker of the Provincial Assembly on the formation of the Koshi government is constitutional or unconstitutional.
